2023-04-24Honourable Mr Justice M.Dhandapani2 pages

W.M.P.No.9703 of 2022 in W.P.SRNo.50771 of 2020 M.DHANDAPANI, J.

The present petition has been filed to restore the above Writ Petition back to file which was dismissed for non-prosecution.

2. The Writ Petition was listed for hearing under the caption 'for maintainability' and when it was taken up, there was no representation for the petitioner on more than two occasions. Hence, the same was dismissed for nonprosecution.

3. A perusal of the record reveals that the above Writ Petition is not maintainable under Article 226 as the same was filed for a direction to the Inspector General, Registration Department to finalize the petitioner's highest quote of Rs.125 crores and transfer the Trust in his name. However, such a direction cannot be granted by this Court, more so with regard to transfer of Trust and merely because a direction is sought to the Inspector General of Registration, the same cannot be said to be maintainable. It is for the appropriate authority to decide with regard to transfer of Trust. https://www.mhc.tn.gov.in/judis
