O R D E R

This revision petition has been filed to direct the learned I Additional District Munsif Judge, Kallakurichi, to dispose of the application filed by the petitioner in I.A.No.998 of 2014 in O.S.No.471 of 2010 2.

The learned counsel appearing for the ninth respondent submitted that the petitioner filed an application in I.ANo.998 of 2014 in O.S.No.471 of 2010 for appointment of Advocate Commissioner. The Court below appointed an Advocate Commissioner to inspect the suit property and to note down the physical features of the property by an order dated 19.08.2014 itself. Thereafter, the Advocate Commissioner did not inspect the suit property and failed to file any report. Therefore, the warrant of appointment was cancelled by the trial and appointed another Advocate Commissioner one S.Illaiyaraja and issued warrant to the newly appointed Advocate Commissioner. Even the new Advocate Commissioner did not

inspect the suit property and did not file any report even till today. Therefore, he sought for necessary direction from this Court. 3.

Considering the above facts, the trial Court is directed to appoint a new Advocate Commissioner, if the earlier Advocate Commissioner did not file any report till now and dispose of the same within a period of three months from the date of receipt of copy of this Order.
