Rajasekar v. The Inspector Of Police,Vellore

2024-03-26Honourable Mr Justice C.V. Karthikeyan2 pages

Crl.O.P.No.7329 of 2024 C.V.KARTHIKEYAN, J.

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379, & 430 of IPC and Section 21(1) of Mines & Minerals (Development & Regulation) Act, 1957 in Crime No.29 of 2023, seeks anticipatory bail. 2.The petitioner has falsely stated that this is the first anticipatory bail application, when actually he had earlier filed an application seeking anticipatory bail in Crl.O.P.No.5426 of 2023 by an order dated 09.03.2023.

3.It is thus obvious that the petitioner is coming to the Court with false plea. Hence, this Criminal Original Petition stands dismissed. If sureties have not been executed in the earlier order granting anticipatory bail to the petitioner, the learned Judicial Magistrate Gudiyattam, should not accept the sureties in the same. 1/2 https://www.mhc.tn.gov.in/judis
