Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of a writ of Mandamus, directing the 2nd respondent herein to hand over the main Door Key of the petitioner's company namely Alankar Zardha Scented Chewing Tobacco Company existing at No.8, Chamundi 1st Street, Shanmuga Nagar, Maniyanoor via, Salem by considering the representation of the petitioner herein dated 13.09.2021. ORDER
The learned Additional Government Pleader appearing for the respondents on instructions would submit that the learned Advocate Commissioner appointed by this Court has filed a report stating that the lock put up in the petitioner's premises does not contain the emblem or the seal of the respondents. On instructions, he would submit that the petitioner's premises were never sealed. According to him, the sample of the adulterated goods was alone taken and a surety bond was executed by the petitioner in favour of the respondents. https://hcservices.ecourts.gov.in/hcservices/
According to him, the only condition stipulated by the respondents was that the petitioner will have to retain the goods which have been seized, till the proceedings initiated against the petitioner attains a finality.
2. The learned counsel for the petitioner on instructions would submit that if the statement made by the learned Additional Government Pleader appearing for the respondents is recorded and in terms of the said statement, this writ petition can be disposed.
3. After recording the statement made by the learned Additional Government Pleader as stated supra, this writ petition is disposed of. No costs.
