Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to depute an officer to inspect and survey the land in Resurvey No. 74/2 and cadastre No. 2368-4/4-2/2-1/2, Thattanchavadi Village, Puducherry and incorporate appropriate correction in the Revenue records.

Mr.D.Ravichandar, learned Additional Government Pleader takes notice for the respondents. By consent of parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the respondent to depute an officer to inspect and survey the land in Resurvey No. 74/2 and cadastre No. 2368-4/4-2/2-1/2, Thattanchavadi Village, Puducherry.

3. It is stated by the petitioner that in the Revenue https://hcservices.ecourts.gov.in/hcservices/

records, the total extent of the land in patta was wrongly stated as 74 ares instead of 88.83 ares. It is further stated that the petitioner made a representation on 08.12.2017 followed by another representation on 15.02.2018 to the respondents seeking for resurvey of the land and to rectify the corrections in the Revenue records. However, the respondents has not considered the same. Hence, the present writ petition is filed before this Court with the relief as stated supra.

4. Heard both sides.

This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the respondents to consider and pass appropriate orders on the same on merits and in accordance with law. Thus, this writ petition is disposed of, only with a direction to the respondents to consider the request of the petitioner and pass appropriate orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the respondents within a period of eight weeks from the date of receipt of a copy of this order. No costs.
