3rd and 4th respondents in A.No.6606 of 2016 Applications filed under XIV Rules 8 of the Original Side Rules to implead the applicants as necessary defendants in the TOS No.50 of 2010.
For Applicant :Mr. F.Camilus Selva For Respondents: Mr. N.Balasubramanian COMMON ORDER The captioned applications have been filed by the applicants/proposed defendants to implead them as defendants 2 to 4 in the pending suit.
2. When the matters came up before this Court today, the learned counsel appearing for the applicants / proposed defendants has filed an additional affidavits dated 21.11.2016 and 22.11.2016 to the effect that the proposed parties have no objection for the grant of Letters of Administration and that, they may be permitted to participate in the final arguments.
3. Learned counsel appearing for the respondents submitted that the respondents have no objection to permit the proposed parties to participate in the final arguments.
4. Taking into consideration of the above submission and also the undertaking given by the proposed parties in the aforementioned additional affidavits, this Court is of the view that the applicants may be given a chance to participate in the the main suit for argument.
The captioned applications are, accordingly, allowed. Ga 22.12.2016
