Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure praying to direct the learned Judicial Magistrate Court No:1 at Poonamalee to complete the trial as expeditiously possible is now pending in C.C.No.229 of 2013 on the file of learned Judicial Magistrate Court No:1 at Poonamalee.

ORDER

This Criminal Original petition is filled seeking direction to the learned Judicial Magistrate Court No:1 at Poonamalee to complete the trial made in C.C.No.229 of 2013 as expeditiously possible.

2. Heard Mr.Vimal B.Crimson, learned counsel for the petitioner and the learned counsel for the respondents. https://hcservices.ecourts.gov.in/hcservices/

3. Mr.Shanmuga Sundaram, learned Senior counsel appearing for respondents 2 & 3 took very serious objections to certain allegations made by the petitioner in his petition, which are not related to the case at hand. However, he fairly stated that a direction may be given to the trial court to complete the trial, as expeditiously as possible.

4. Be that as it may, without going into the said allegations, this Court is of the view that interest of Justice will be served, if a direction is given to the trial Court to complete the trial in C.C. No.229 of 2013, within a period of six months.

5. In view of the above, the accused is directed to cooperate with the trial Court and cross-examine the prosecution witnesses on the day they are examined-in-chief, as held by the Supreme Court in Vinodh Kumar Vs State of Punjab reported in 2015[1] MCJ [Crl] 288. The accused shall not adopt any dilatory tactics.

6. With the above directions, this Criminal Original Petition is disposed of.
