S.Kushal Raj v. Manoj Kumar B Jain
O.A.No. 309 of 2019 in C.S.No. 214 of 2019 R.SUBRAMANIAN, J.
Despite service of notice as early as on 27.03.2019, the respondent has not chosen to enter appearance and contest the application.
2. From the allegations made in the affidavit filed in support of the application, I find that the applicant had made out a prima facie case for grant of injunction in as much as the respondent had received the entire sale consideration payable under the sale agreement dated 30.05.2018. I also find that the balance of convenience is also in favour of the applicant. Hence, this application is allowed granting interim injunction restraining the respondent/defendant from encumbering or alienating the property subject matter of the suit, till the disposal of the suit. 11.06.2019 kkn http://www.judis.nic.in
