Respondents Prayer in the Writ petition: Writ petition filed under Article 226 of the Constitution of India to issue a Rit of Mandamus, order or direction in the nature of a Writ, directing the respondents to accept the petitioner's application to take part in the recruitment process for the post of Junior Draughting Officers in Highways Department issued by the 2nd respondent in notification No.12390/Nir(1)/2014 dated 26.10.2015 without reference to the amendment to the general rules (Vol. I of the Tamil Nadu State Services Manual 1987) vide Rule 54(B) vide G.O.Ms.No.114 dated 11.08.2010 and consequently without reference to clause 2 of the notification of the 2nd respondent so far as the petitioner is concerned by implemending the G.O.Ms.No.98, Personnel and Administrative Reforms Department, dated 17.07.2006 by increasing the upper age limit of MBC and BC candidates from 32 to 40 years. This writ petition has been filed by the petitioner challenging the notification issued by the 2nd respondent in No.12390/Nir 5(1)/2014 dated 26.10.2015.
2. The learned Additional Government Pleader submitted that pending writ petition, the Government has passed an order in G.O.(Ms) No.177, (HM-1) Department dated 24.10.2018, thereby canceled the earlier notification issued by the 2nd respondent with regard to the process of recruitment to the post of Junior Draughting Officers and therefore, nothing survives for further adjudication in the writ petition. He has also placed the above said Government Order before this court.
3. Inview of the submission made by the learned Additional Government pleader and in the light of the Government Order in G.O.Ms.No.177 (HM-1) Department dated 24.10.2018, this writ petition is dismissed as infructuous. No costs.
