O R D E R

The present criminal original petition has been filed to direct the respondents to register a case on the complaint of the petitioner dated 18.08.2015.

2. The petitioner herein has lodged a complaint as against one Suresh and Meena, who are running an un-registered chit business. The petitioner has been paying chit amount to them regularly. But, they have not paid the chit amount to the tune of Rs.16,00,000/-, which was collected from the petitioner. When the petitioner questioned the same, they abused her with filthy language and assaulted them. Though a complaint has been lodged on 18.08.2015, till date no action was taken. Hence, the petitioner has come forward with the present criminal original petition.

I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor. 4.

When the matter was taken up for consideration today, the learned Additional Public Prosecutor submitted that the petitioner is not cooperating with the respondent police for enquiry. If he co-operates, necessary action will be taken. 5.

In view of the submissions made by the learned Additional Public Prosecutor, this Court directs the second respondent to conduct enquiry on the complaint lodged by the petitioner dated 18.08.2015 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, is directed to proceed further in accordance with law, as early as possible. If no prima facie case is made out for registering the case, the second respondent is directed to pass an appropriate order on the complaint of the petitioner. The petitioner is also directed to co-operate with the respondent for enquiry.

With the above directions, the Criminal Original Petition is disposed of.
