Criminal Original Petition filed under Section 482 of Cr.P.C. praying to call for the records in Crl.M.P.No.70/2018 in Spl.C.C.No.5/2014 order dated 02.01.2018, pending on the file of Chief Judicial Magistrate, Chengalpet and set aside and relax the condition imposed to the petitioner.

ORDER

The petitioner herein has approached the Trial Court to recall the warrant issued against him for his non appearance on 12.01.2018, the same has been recalled on 17.01.2018, on condition that he should report before the Court daily. When he sought for relaxation before the Chief Judicial Magistrate, the Chief Judicial Magistrate has dismissed the petition. Perusal of impugned order, indicates no reason assigned for not considering the request for relaxing the bail condition. Aggrieved by the dismissal order, the petitioner has approached this Court by filing a petition under Section 482 of Cr.P.C.

Heard the learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the respondent.

It appears that the case of the year 2014, is pending without much progress. It is also stated that presently, there is no Presiding Officer is in the Court concerned. https://hcservices.ecourts.gov.in/hcservices/

In the light of the above facts, this Court is inclined to relax the condition to the effect that the petitioner shall appear before the Trial Court on first and fifteenth of every month and also on date of hearing without any failure.
