ORDER : The Court Made the following order :- The petitioner herein, who was arrested on 28.02.2022 for the alleged offence under Sections 341, 392 of IPC, in Crime No.60 of 2022, seeks bail.

2. The petitioner herein is one among the 4 accused against whom, the respondent police has registered a case under Sections 341 and 392 of IPC. The case of the defacto complainant is that one Selvam defrauded the defacto complainant through face book and asked her to come to an isolated place. When they were talking alone, the other three accused persons came and restrained them under threat and snatched her 8 1/2 sovereign chain. Thereafter, she realized that those three persons were invited by her own friend Selvam, when the face book account of Selvam was closed. Based on her complaint, the respondent police has arrested three persons whereas the fourth accused is still absconding and 6 1/2 sovereigns of jewel was recovered from A1 and the balance two sovereigns is yet to be recovered.

3. This petitioner seeks bail on the ground that he is in prison for more than 40 days. However, the learned Additional Public Prosecutor for the respondent police states that since one of the accused is still absconding and part of the stolen article is yet to be recovered, if the petitioner is released on bail, there is possibility of absconding and screening of evidence. 4.Though the learned counsel for the petitioner states that the petitioner is friend of A1 and he has not involved in the crime, the statement of the witnesses and the arrested accused indicates his involvement in the the crime. In the said circumstances, this Court is not inclined to grant bail to the petitioner herein at this juncture. Hence, this Criminal Original Petition for bail is dismissed.
