A.No.1808 of 2022 Application praying that this Hon'ble Court be pleased to recall witness DW1 Mr. Jaspeet Singh and permit him to lead oral evidence in respect of the additional Documents in Serial Nos. 1 to 3. This Application coming on this day before this court for hearing, the court made the following order:- These two applications have been presented by the first and second defendants to recall DW1 and permit the said defendants to exhibit the additional documents specified in the schedule to the Judge's Summons, respectively.
2. Learned counsel for the applicants/first and second defendants states that these applications were filed in view of the questions put to DW1 in relation to the shareholding pattern of the third defendant.
3. Learned counsel for the plaintiff and the fourth respondent state that the shareholding pattern of the third defendant is not germane to the adjudication of the suit and that they do not propose to rely on the answers
provided by DW1 in relation thereto.
4. In view of the categorical assertion on behalf of the plaintiff and the fourth defendant, it is not necessary to recall DW1 or bring the additional documents on record.
5. By recording the aforesaid submissions on behalf of the plaintiff and the fourth defendant, these applications are closed. List on 29.06.2022.
