This Original Petition filed seeking probate of the "Will" deed dated 14.03.2005 executed by Kamalammal, who died on 19.06.2006.
2. The petitioner is the executor under the Will. The respondents have given their consent affidavits. The petitioner was invited to adduce evidence. The petitioner was examined as P.W.1. The original registered Will dated 14.03.2005 is marked as Ex.P2 and the legal heirship certificate as Ex.P.3. The consent affidavits of respondents are marked as Exs.P6 to P10.
2. The petitioner examined one Mrs.V.Bhavani, who was one of the attesting witnesses, as P.W.2, and Mrs. G. Kumuthavalli, who was the other attesting witness, as P.W.3. Both of them confirmed the execution of the Will, Ex.P1, and the signatures therein. They stated that Kamalammal was in sound and disposing state of mind at the time of execution of the Will. Their affidavits are marked as Exs.P11 & P12.
4. In view of the evidence adduced, this Court holds that the petitioner has proved the Will. Therefore, the petitioner is entitled to grant of probate. https://www.mhc.tn.gov.in/judis
