The learned counsel for the petitioner submits that the issue has been resolved between the petitioner and the respondent who is the complainant filed a case under Section 138 of N.I.Act. The petitioner has paid Rs.4,00,000/-, the cheque amount by way of demand draft bearing No.798925, drawn on Karur Vysya Bank, Salem. She submits that once the notice is ordered to the respondent and can file a petition under Section 147 of N.I.Act.

2. In view of the same, this petition is ordered accordingly and the delay stands condoned.
