The present criminal original petition has been filed to set aside the conditions No.2, 3 and 4 imposed in the impugned order of the learned Judicial Magistrate No.III, Erode, in C.M.P.No.6526 of 2011 dated 18.8.2011 and order the respondent / accused to be handed over to the custody of the petitioner / complainant.

2. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor, appearing for the petitioner submitted that nothing survives for adjudication in this matter.
