Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the order dated 09.04.2021 made in Ka.No.458/NePi-3/NeOo2/Ko.Va.Ve/2021 by the Respondent No.3 and to Quash the same consequently direct the Respondent No.3 herein to provide employment to the Petitioner's daughter namely V.Megavarthini on compassionate ground within a timeframe fixed by this Hon'ble Court. ORDER

This writ petition has been filed challenging the order passed by the third respondent, thereby rejected the request made by the petitioner seeking appointment on compassionate ground.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner's husband, while he was working as lineman in the respondent Corporation, died on 20.12.2011. On his demise, the petitioner had applied for employment on compassionate ground by the

representation dated 10.03.2014. The petitioner was directed to furnish relevant documents to consider her request. The petitioner obtained certificate from the Tahsildar certifying that her family is in indigent condition. However, subsequently it was rejected, on the ground that the petitioner did not possess sufficient educational qualification. Once again, the petitioner submitted an application seeking appointment on compassionate ground for her daughter. Admittedly, the petitioner's daughter was minor on the date of demise of the petitioner's husband. Her daughter attained majority in the year 2020 and thereafter, made an application seeking appointment on compassionate ground. After a period of 13 years from the date of her husband's demise, the application seeking employment on compassionate ground cannot be considered.

4. Therefore, the request made by the petitioner was rightly rejected by third respondent and this Court finds no infirmity or illegality in the order passed by the third respondent and the writ petition is devoid of merits and is liable to be dismissed.

5. Accordingly, this writ petition stands dismissed. Consequently, connected Miscellaneous petition is closed. There shall be no order as to costs.
