The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act in Cr.No.1616 of 2020, on the file of respondent police pending trial in C.C.No190 of 2021 on the file of II Additional Special Judge, NDPS Act, Chennai, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused persons were found in possession of 23 kgs of Ganja. On the basis of confession given by the petitioner, A3, A4 and A5 who were found in possession of 30, 40, 25 Kgs of Ganja respectively and the same was recovered and all the accused persons were arrested and remanded to judicial custody by the respondent police and registered a case agianst them.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is falsely implicated in this case. Hence he prays to grant bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. The learned Additional Public Prosecutor submits that the petitioner and other accused persons were found in possession of 148 kgs of Ganja illegally. Hence he vehemently opposed to grant bail to the petitioner.

5. Taking into consideration the allegations and also the bad antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner.
