Though the proposed respondents 4 and 5 have been served by publication, they have not entered appearance. Hence, they are called absent.

2. These applications have been filed for condonation of delay of 878 days in setting aside the abatement caused by the death of the 2nd defendant, for setting aside the abatement and for bringing on record the proposed parties namely, the respondents 4 and 5 herein as legal representatives of the deceased 2nd defendant.

3. Considering the reasons assigned in the affidavits filed in support of these applications, the delay of 878 days in filing the application seeking to set aside the abatement is condoned, abatement caused by the death of the 2nd defendant is set aside and the proposed parties namely, respondents 4 and 5 are brought on record as defendants 4 and 5 in the suit as legal representatives of the deceased 2nd defendant.
