Respondents Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the 2nd respondent to monitor the investigation and enquire the matter on the basis of the complaints given by the petitioner to the respondents dated 29.06.2016 and investigate the matter in accordance with law.

ORDER

This criminal original petition has been filed seeking a direction to the 2nd respondent to monitor the investigation and enquire the matter on the basis of the complaint given by the petitioner to the respondents dated 29.06.2016 and investigate the matter in accordance with law.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor (Crl.side) appearing for the Respondents.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor (Crl.side) submitted that since there are several disputes between the petitioner and the opposite party, proceedings under Section 107 Cr.P.C, has been initiated. That apart, the complaint dated 29.06.2016 does not https://hcservices.ecourts.gov.in/hcservices/

disclose the commission of any cognisable offence for the police to register an FIR. Inasmuch as there are two cases pending against each other viz., Crime No.413 of 2016 and Crime No.427 of 2016, no positive direction can be given to the respondent police to register a case and this petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
