W.P.M.P.No.113 of 2015 in W.P.No.9562 of 2000 RMT.TEEKAA RAMAN,J., This petition is filed to permit the petitioner to withdraw the sum of Rs.66258/- lying to the credit of W.P.No.9562 of 2000 before this Court together with accrued interest therein.

2. After hearing the learned counsel appearing for the petitioners and the respondents, I find that as against the order made in W.C's case, the regular effective and alternative remedy, the W.P.M.P is filed with deposit of the entire amount.

3. Pursuant to the impugned order, at the time of admission 50% of the award amount has been deposited and the Writ Petition has been dismissed for default. Now, the petition is filed to be set aside the ex-parte order of dismissal with petition to condone the delay of 1938 days. The L.R's of the deceased labourer has filed W.P.M.P.No.113 of 2015 for withdrawal of the 50% of the amount.

4. Without prejudice to the rights and contentions of both the parties, the L.R of the Labourer namely the petitioner in the W.P.M.P is permitted to withdraw the amount. The amount in the bank with which deposited is permitted to close the fixed deposit and credit to the account of the L.R of the deceased.
