Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the 1st to 3rd respondents to removal the encroachment made by the 4th to 7th respondents in the Government Poramboke land situated in S.No.10B/31 to an extent of 52 cents at Kamaraj Street, Manapakkam, Village, Melacherry Village, Chengalpattu District and to restore the said land from the encroachers for public purposes by considering the petitioner's representation dated 15.02.2024.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.M.Dinesh, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader assisted by Mr.T.K.Saravanan, learned Government Advocate for respondents 1 to 3.

2. Encroachment is alleged on the land situated in S.No.10B/31.

3. The extract of the A-Register, as translated by the petitioner, depicts the said land to be a natham land. 'Natham' would mean 'residential'.

4. There is no clarity with regard to the documents placed on

record. The petitioner shall approach the appropriate Committee constituted under the Government Order bearing G.O.Ms.No.64 dated 08.02.2022. If such an application is filed by the petitioner, the concerned Committee shall decide the same on its own merits and in accordance with law after adhering to the principles of natural justice preferably within a period of eight weeks from the date of the application.

5. The writ petition, as such, stands disposed of. There shall be no orders as to costs.
