ORDER

By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with.

2. This writ petition has been filed for a direction, directing the 1st respondent to forthwith dispose of the Execution petition dated 3.12.2025 in E.C.No.81 of 2018 including the calculation of interest on the remaining undeposited amount and imposition of penalty under section 4A(3) of Employees compensation Act and to issue a Revenue Recovery certificate to the District Collector, Coimbatore for the recovery of the balance compensation amount from the respondents No.2 to 4 and disburse the same to the petitioner.

It is the case of the petitioner that the petitioner suffered a greivous industrial accident on 12.11.2021 while working at the second respondent cotton mill resulting in amputation of three fingers of right hand. Since the respondents 2 and 4 not provided due compensation, the petitioner filed EC.No.81 of 2018 before the first respondent. The first respondent passed award dated 17.09.2025 directing the respondents 2 and 4 to pay Rs.2,57,026/- with 12% interest per annum from 18.11.2011. However, the respondents 2 and 4 deposited only the principal amount and filed to deposit the interest. Hence, the petitioner filed Execution Petition on 03.12.2025 before the first respondent which is pending without consideration. Hence, this petition.

4. Heard the learned counsel for the petitioner and the learned Government Advocate and perused the materials placed on record.

5. Considering the limited relief sought for in this writ petition, this Court without going into the merits of the case directs the first respondent to dispose of the Execution Petition filed by the petitioner in EC.No.81 of 2018 dated 03.12.2025 and pass appropriate orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this Order.
