J U D G M E N T

This Criminal Appeal arises against the judgment made in S.C.No.97 of 2006 dated 20.10.2006 passed by the learned Judge, Assistant Sessions Court, Bhavani convicting the appellant herein under Section 354 of IPC to undergo 2 years R.I and under Section 376 IPC to undergo 10 years R.I with fine of Rs.1,00,000/- in which Rs.95,000/- to be paid as compensation to the victim and under section 377 of IPC to undergo 10 years R.I with fine of Rs.1,00,000/- in which Rs.95,000/- to be paid as compensation to the victim.

2. Learned Counsel for appellant as also learned Government Advocate (Crl.side) have submit that appellant died on 23.12.2011. Copy of the death certificate has also been produced.

3. In view of the above stated position, this Criminal Appeal is dismissed as abated.
