Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to To pass an order directing the Second Respondent / Writ Petitioner Management to pay him last drawn salary a sum of Rs.6300/- every month till the (in WMP No.23141 of 2017) disposal of the above Writ Petition No.14971/2017 Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.CHANDRASEKAR.P, Advocate for the petitioner and of Mr.ARUN A1 RASHEED FOR M/S.T.S.GOPALAN & CO., on behalf of the Respondents the court made the following order:- In respect of the dispute raised by the workman, the labour court has passed an award dated 05.10.2016 in I.D.No.353 of 2015, directing reinstatement with back wages with all other attendant benefits. This award is in challenge in the writ petition.
2. Pending disposal of the above writ petition, the workman has filed the present miscellenous petition claiming wages under Section 17-B of the Industrial Disputes Act. The last drawn wages as stated in the affidavit filed in support of the petitions, is Rs.6,300/- (Rupees Six Thousand Three Hundred only) per month. 3. Heard both sides. Considering the facts and circumstances of the case, the management is directed to pay the 17-B wages (last drawn wages) from the date of the filing of the writ petition till the disposal of the writ petition. The arrears of 17-B wages shall be within a period of four weeks from the date of receipt of a copy of this order. For the subsequent period, the 17-B wages shall be paid on the 10th day of each succeeding month. The petition is ordered accordingly.
