O R D E R
The Writ of Mandamus has been sought to direct the 1st respondent to consider the representation of the petitioner dated 22.03.2022, thereby take suitable departmental and legal
action against respondents 2 to 4.
2.Today, when the matter is taken up for hearing, the learned Counsel for the petitioner submitted that the 2nd respondent is the Inspector of Police, Kuthalam Police Station, Mayiladuthurai District. He further submitted that 2nd respondent, along with 3rd respondent, indulged in illegal activities. The 2nd respondent has also falsely implicated the petitioner in Crime No.80 of 2022, which was registered for the offences under Sections 294(b), 448, 506(2) of IPC. The petitioner had sent a representation to the 1st respondent seeking to take action against the respondents 2 and 3, who are repeatedly indulging in illegal activities. However, 1st respondent has not taken any action so far on the representation of the petitioner dated 22.03.2022.
He would further submit that the 1st respondent being a Statutory Authority is bound to take action on the representation of the petitioner. 3.The learned Additional Public Prosecutor appearing for the respondents would submit that the Superintendent of Police, Mayiladuthurai is the appropriate authority to take action on the representation of the petitioner, whereas the petitioner has forwarded the representation to the Director General of Police, Chennai and in the usual process, it would be forwarded to the Superintendent of Police, Mayiladuthurai District for taking appropriate action.
4.At this juncture, the learned counsel appearing for the petitioner would submit that the petitioner is now prepared to send a fresh representation to the Superintendent of Police, Mayiladuthurai and he would pray that a direction may be issued to the Superintendent of Police, Mayiladuthurai to consider the representation and dispose of it within a time frame to be fixed by this court.
5.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
6.The petitioner has made allegations as against the respondents 2 to 4 for impleading him in a false cases. The petitioner has send a representation to the 1st respondent Police and the Superintendent of Police, Mayiladuthurai is the authority to take action as against the respondents 2 to 4. 7.In view of the submissions made by the learned counsel appearing for the petitioner, this Writ petition stands disposed of, with a direction to the petitioner to give a fresh representation to the Superintendent of Police, Mayiladuthurai, who shall consider the same and dispose of it within a period of
two months from the date of receipt of the fresh representation. It is made clear that this court has not expressed any opinion with regard to the contents of the representation. The superintendent of Police, Mayiladuthurai, is at liberty to dispose of the representation in accordance with law. No costs.
