DATED:22.07.2019

CORAM:

THE HONOURABLE MR.JUSTICE M.GOVINDARAJ C.R.P.(PD) No.2336 OF 2019 1.Premavathi 2.Prakash 3.Ramya ... Petitioners Vs.

Ravichandran ... Respondent PRAYER: Civil Miscellaneous Appeal filed under Article 227 of Constitution of India, praying to set aside the order dated 20.02.2019 made in I.A.No.250 of 2018 in O.S.No.119 of 2008 on the file of the District Munsif Court, Dharapuram.

For petitioner : Mr.A.K.Sridharan ***

O R D E R

The petitioners seeks production of public document through District Collector under Rule 76 CRP.

2. At the first instance, the petitioners approached Tahsildar for those documents and the Tahsildar provided only the documents between the year 2003 to 2008 and stated that the documents prior to the year 2003 were not available with him and informed the petitioners to approach the District Collector, Tiruppur, for securing such documents. Without approaching the District Collector, the petitioners have chosen to file a petition for production of those documents.

3. The Trial Court, considering the petition filed by the petitioners, observed that the petitioners are not entitled to approach the Court directly without making any attempt to get the documents from the District Collector since they are public documents. The petitioners have every right to approach the Public authorities and get those documents.

4. In the considered opinion of this Court, the findings given by the Trial Court is very much correct. It is not open to the petitioner to approach the Court without making any attempt in securing public documents from the Public Authority. The Civil Revision Petition merits no consideration and accordingly dismissed. No costs. 22.07.2019
