ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the 2nd respondent to release the settlement deed dated 22.02.2025, which is kept as a pending document.

2.When the matter came up for hearing on 20.03.2025, this Court passed the following order:

Mr.U.Bharanidharan, learned Special Government Pleader, takes notice for respondents.

The learned Special Government Pleader on instructions submitted that the settlement deed presented for registration was not released on two grounds and they are :- (a) There is a deficit stamp duty payable, when the earlier sale deed was registered as document No.2056 of 2025 and (b) A protest petition was received from one Thabitha Chellammal and two others.

2. Post this case under the caption "for orders" on 17.04.2025 3.When the matter was taken up for hearing today, the learned counsel for the petitioner submitted that the entire deficit stamp duty to the tune of Rs.2,25,130/-, registration fee of Rs.64,325/- and compounding fees of Rs.255/- were paid on 16.04.2025. To substantiate the same, the acknowledgement for receipt of these payments was produced.

4.In the light of the above development, the first ground that was raised on the side of the respondents does not survive. Insofar as the second ground pertaining to the protest petition given by one Thabitha Chellammal, unless and otherwise, there is anything material to consider, a mere protest petition will not stop the Sub Registrar from registering the document.

5.In view of the above, there shall be a direction to the 2nd respondent to take a decision on the protest petition and if there is no material, shall proceed further to register the sale deed dated 22.02.2025, if it is otherwise in order. 6.This writ petition is disposed of with the above directions.
