Heard the learned counsel for the petitioner and Mr.T.N.Rajagopalan, learned Special Government Pleader for the respondents.
2. This writ petition has been filed under Article 226 of the Constitution of India for issuance of a writ of mandamus directing the respondents to dispose the petitioner's representation dated 30.4.2015 within a reasonable time to be fixed by this Court.
3. A reading of the request made by the petitioner in the said representation dated 30.04.2015 clearly shows that he should be allowed to excavate soud from the Eri situated in S.No.171, Kumaracherry Village, Tiruvallur.
4. It is at this point of time, Mr.T.N.Rajagopalan, learned Special Government Pleader appearing for the respondents placing on record the rejection order already passed on 09.07.2014, urged before this Court that though a copy of the said rejection order has already been communicated to the petitioner, concealing the same, the present writ petition is filed and hence, he prays for dismissal of the writ petition, as nothing survives for adjudication. https://hcservices.ecourts.gov.in/hcservices/
5. However, the learned counsel for the petitioner submitted that the said rejection order was not served on the petitioner and hence he filed this writ petition with the aforesaid prayer.
6. When the petitioner's request has already been negatived by order dated 09.07.2014, this writ petition fails and the same is dismissed. No costs.
7. Since it is represented by the learned counsel for the petitioner that the rejection order dated 09.07.2014 has not been served on the petitioner, the learned Special Government Pleader is directed to furnish a copy of the said rejection order dated 09.07.2014 to the learned counsel for the petitioner during the course of the day.
