PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the second respondent to issue sale deed for the market price and within stipulated time fixed by this Court.

ORDER
Heard the learned counsel for the petitioners and the learned Standing Counsel accepting notice for the respondents.
2. The writ petition has been filed seeking for a direction to the second respondent to issue the sale deed for the market price within a stipulated time.
3. It is brought to the notice of this Court that already, two earlier writ petitions filed by the petitioners were dismissed.
4. There is absolutely no mention about the said fact in the affidavit filed in support of this writ petition.
5. When this Court posed a question as to the non revealing of the said fact, the learned counsel for the petitioners has sought for withdrawal of this writ petition with liberty to file a fresh writ petition. She has also made an endorsement in the bundle today to that effect. 2/4
6. Accordingly, the writ petition is dismissed as withdrawn. However, liberty is granted to the petitioners to file a fresh writ petition. No costs.
