ORDER

This Criminal Original Petition has been filed, seeking direction to the the 1st and 2nd respondents to execute the Non-Bailable Warrant against the 3rd respondent issued by the learned Judicial Magistrate (Fast Track Court) Kallakurichi in CC.No.111 of 2017, by order dated 25.11.2025.

2. When this matter was taken up for consideration i.e., on 11.03.2026, this Court has passed the following direction: "5. In view of the same, the first respondent is directed to file a status report giving details about what steps have been taken with regard to execution of the conviction warrant despite the letter sent by the learned Judicial Magistrate on 25.11.2025, which was received by the first respondent on 27.11.2025."

3. Pursuant to the above direction of this Court, a status report filed by Gautam Goyal. IPS, Superintendent of Police, Salem District, dated 21.03.2026, has been produced before this Court. Paragraph No.5 of the status report is extracted hereunder for easy reference:

"5. It is further submitted that, based on the information received from the informant, on 13.03.2026 at about 08.00 hours, the accused, Mala, was apprehended at her residence and taken to Attur Government Hospital for medical examination. The attending doctor advised consultation with a nephrologist. Subsequently, the accused was produced before the Fast Track Court, Kallakurichi in execution of the Non-Bailable Warrant, and she was remanded to judicial custody. Thereafter, she was admitted to Government Medical College Hospital,

Adukkamparai, Vellore, for treatment of uterine and kidney stone related ailments, where she continuous to undergo treatment to till date."

4. On perusal of the report, particularly paragraph No.5, it appears that the accused was secured and produced before the Fast Track Court, Kallakurichi in execution of the Non-bailable warrant, and thereafter remanded to judicial custody.
