The suit is at the pre-trial stage. The applicant / plaintiff states that the documents proposed to be brought on record are necessary to establish the validity of the trademark registrations in its favour. It is also stated that the said documents could not be filed along with the plaint in view of the requirement of collecting details from hundreds of distributors. It is also stated that the written statement has not been filed and therefore no prejudice would be caused. In the circumstances, the applicant has established reasonable cause.

2. Therefore, A.No.1668 of 2022 is allowed subject to the objections of the respondent / defendant inter alia on grounds of admissibility, relevance and proof.
