C.M.P.No.7723 of 2023 in C.M.A.SR.No.38977 of 2023 N.ANAND VENKATESH, J.

This Civil Miscellaneous Petition has been filed seeking to condone the delay of 237 days in filing the above Civil Miscellaneous Appeal against the order dated 06.04.2022 made in M.C.O.P.No.130 of 2018 on the file of the Motor Accident Claims Tribunal, Special District Court, Erode.

2.Notice to 1st respondent is dispensed with since, the 1st respondent remained exparte before the Tribunal. The respondents 2 & 3 are represented through counsel.

3.Heard the learned counsel for the petitioner and respondents 2 & 3 and perused the records. 4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 237 days is condoned.

5.It is made clear that for the period of delay of 237 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal. 6.The name of the counsel for the respondents 2 & 3 shall be printed in the cause list at the time of admission.
