Prayer: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified mandamus, calling for the records relating to the order of the 2nd respondent passed in No. INS III/51001301900001302 dated 04.02.2021 and quash the same and direct the respondents to write - off the demand of a sum of Rs.8,84,487/- under Section 91 - C of the ESI Act, 1948. The Writ Petition is filed for the following relief: "Writ of Certiorarified mandamus, calling for the records relating to the order of the 2nd respondent passed in No. INS III/51001301900001302 dated 04.02.2021 and quash the same and direct the respondents to write - off the demand of a sum of Rs.8,84,487/- under Section 91 - C of the ESI Act, 1948"

2. Though the Writ Petition has been filed for the above relief, the petitioner would submit that they are aggrieved by the fact that the respondents have not considered the response given by the petitioner 2/5

on 02.12.2020 before passing the impugned order on 04.02.2021.

3. Considering the above fact, the Writ Petition is disposed of setting aside the order impugned and remitting the matter back to the 2nd respondent to consider the reply of the petitioner dated 02.12.2020 and thereafter pass orders. The said exercise shall be completed within a period of 2 months from the date of receipt of a copy of this order. It is needless to state that till the disposal, the impugned order shall not be given effect to.

4. The Writ Petition is disposed of with the above directions. Consequently, the connected miscellaneous petition is closed. No costs.
