ORDER
It is submitted by the learned counsel for the respondent Management that pursuant to the order passed under Section 17 (b) of the Industrial Disputes Act, the respondent Management has been paying the salary to the petitioner.
2. However, learned counsel for the petitioner would submit that though the salary is being paid, it is being paid belatedly. Learned counsel for the respondent Management would submit that, henceforth, they shall pay the salary to the petitioner before the fifth day of every English calender month. However, he would submit that aggrieved by the order passed by the learned Single Judge, a Writ Appeal has been filed, which is in the stage of numbering. Since 17(b) wages have been paid till date, this Court cannot keep this Contempt Petition pending.
3. After recording the submissions made by the respective counsels, this Contempt Petition is closed. However, in case the respondent Management commits any default in payment of the 17(b) wages or they fail 2/5
to get interim order of stay of the order passed by the learned Single Judge, the petitioner is entitled to revive this Contempt Petition. 28.10.2022 Index : Yes/No Speaking Order : Yes / No ab 3/5
