ORDER

This Criminal Original Petition has been filed to transfer the case in P.R.C.No.3 of 2014 on the file of the Chief Judicial Magistrate of Chengalpattu to X Metropolitan Magistrate at Egmore, Chennai.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is seen that the case is only at the stage of committal in P.R.C.No.3 of 2014 and at this stage, the petitioner has come with this petition for transfer.

4. In the considered opinion of this Court, a transfer, at the time of committal, would cause prejudice to the complainant, inasmuch as committal proceedings have to be conducted by the Magistrate bearing in mind the principles laid down under Section 209 Cr.P.C. Hence, the petition is dismissed with liberty to the petitioner to approach this Court, if the cases are committed to https://hcservices.ecourts.gov.in/hcservices/

the Court of Sessions if there are an good grounds. Consequently, connected miscellaneous petition is closed.
