PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay interest of 12% to the petitioners for belated payment of Gratuity, Leave Salary, Provident Fund and Commutation of Pension amounts within a time frame. ORDER
The writ petition is filed for the relief set out below: "directing the respondents to pay interest of 12% to the petitioners for belated payment of Gratuity, Leave Salary, Provident Fund and Commutation of Pension amounts within a time frame."

It is the case of the petitioners that after serving in the respondent Corporation, the petitioners had retired from service, on attaining the age of superannuation, on 31.07.2024, 30.04.2017, 31.01.2018, 30.04.2024 and 30.04.2019 respectively. The respondents had settled all the retiral benefits including Service Gratuity, Provident Fund, Leave Salary and Commutation amount etc., only on 02.12.2025, 11.01.2018, 03.11.2018, 12.02.2025 and 2/5
05.02.2021 with a delay of more than 1 1⁄2 years. Therefore, the respondents are legally bound to pay interest to the petitioners. The petitioners have made representations to the respondents to pay the interest for the belated payment of Provident Fund, Earned Leave Salary, Gratuity Amount and Commutation amount. Since the same was not considered to date, the petitioners are before this Court.

The learned Standing Counsel for the first respondent would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4. Heard the learned counsel on either side and perused the materials available on records.
5. Admittedly, the Earned Leave Salary, Gratuity Amount, Provident Amount and Commutation Amount etc., have been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Earned Leave Salary, Gratuity Amount, Provident fund and Commutation Amount etc., within a period of six weeks 3/5
from the date of receipt of a copy of this order.
