ORDER
The petitioner, who was arrested and remanded to judicial custody on 27.03.2025 for the alleged offences under Sections 5(1), 6(1), 11(4) and 12 of POCSO Act 2012 r/w 351(2) of BNS in Crime No.9 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner was working as a mason in the de facto complainant/ victim house. On 28.08.2024, when the de facto complainant was alone in her home, the petitioner came to her house and committed sexual assault on the minor victim girl. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been incarcerated since 27.03.2025. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.
4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that eight witness have been examined so far and hence, he opposed the grant of bail to the petitioner.
5. I have given my anxious consideration to either side submissions and perused the materials available on record.
6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the trial is at advanced stage and looking at the allegation of the petitioner which is grave in nature, this Court is of a firm view
that, notwithstanding the petitioner is in incarceration since 27.07.2025, enlarging the petitioner on bail at this juncture, then the same would affect the prosecution case and may also cause trauma in the mind of the victim. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
