The learned counsel for the petitioner would submit that he has already deposited the entire arrears amount and that the appeal has also been numbered. During the pendency of the appeal, the respondent seeks to execute the decree.

Considering the submissions made and in the interest of justice, a direction is issued to the petitioner to work out his remedy before the Appellate Court within a period of four weeks from the date of receipt of a copy of this order. Till such time, the respondent is directed not to precipitate the issue before the Execution Court. The petitioner shall continue to pay the rentals without any default. The Lower Appellate Court is directed to dispose of the stay petition within a period of three weeks from the date of receipt of a copy of this order.
