ORDER
The Criminal Original Petition has been filed by the petitioner under Section 482 of Cr.P.C., to direct the 3rd & 4th respondents to not to harass the petitioner herein and her family under the guise of investigation pertaining to find out her husband.
2.The learned counsel for the petitioner would submit that the petitioner is having three children. The petitioner's husband worked as an assistant to one Kothandam, who is the native of rettanai and engaged in the business of selling spirit. Due to the said employment, the petitioner's husband often got arrested and remanded in jail. For the said reasons and for the better future of her children and safety, the petitioner got separated from her husband and living separately with her children for the past three years without having any iota of financial aid and contact of her husband. While things remain so, the 4th respondent with some unknown persons are disturbing the peaceful life of the petitioner's family under the guise of raid in day and night. Hence, this petition. 3.The learned Government Advocate (Crl. Side) appearing for the respondents would submit that the petitioner's husband has involved in the offence prohibited under law and his whereabouts are not known for the past four years.
4.It is seen from the records that the petitioner's husband is the prohibited offender, for which the respondent police is searching the husband of the petitioner.
5.Considering the facts and circumstances of the case that the petitioner got separated from her husband and living with her three children. Therefore, the 3rd and 4th respondents are hereby directed not to harass the petitioner under the guise of investigation.
6.With the above direction, this Criminal Original Petition stands disposed of.
