HIGH COURT LEGAL SERVICES COMMITTEE, CHENNAI National Lok Adalat-I organised by the High Court Legal Services Committee Monday, the 12th day of December, 2022 LOK ADALAT AWARD (Chapter VI and u/s 21 of Legal Services Authorities Act, 1987) Presided over by The Hon'ble Mr.JUSTICE M.JEYAPAUL(Retd.) and Member Mr. R.Ramaraj, District Judge (Retd) Crl.R.C.No.402 of 2021 and Crl.MP.Nos.6495 & 6496 of 2021 This Criminal Revision Petition has been filed to set aside the judgment in C.A.No.86 of 2019 dated 08.06.2020 on the file of the learned Principal Sessions Judge, Namakkal confirming the conviction and sentence made in CC.No.39 of 2016 on the file of the learned Judicial Magistrate No.I, Namakkal sentencing the petitioner to undergo simple imprisonment for 6 months and to pay compensation of Rs.10,00,000/- and pass further orders.

M/s.Revathi Manivannan, learned counsel for the Petitioner and Mr.S.Arunprasath, learned counsel for the respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The Revision Petitioner K.Subramaniam, having been aggrieved by the conviction and sentence passed by the Trial Court and confirmed by the Appellate Court in a case under Section 138 of the Negotiable Instruments Act, preferred the present Criminal Revision Petition.

2. Both parties having negotiated the whole issue arisen in this case and filed before the Lok Adalat a compromise petition.

3. As per the terms of the compromise, the parties have agreed for setting aside the conviction and sentence passed by the Trial Court and confirmed by the Appellate Court in the present case, in as much as the cheque amount of Rs.5,00,000/- and interest amount of Rs.50,000/- have been paid by the petitioner to the respondent.

4. In view of the above terms of compromise, the judgment of conviction and sentence passed by the Trial Court and confirmed by the Appellate Court is set aside and as a consequence, this Criminal Revision 2/4

Petition case stands allowed. The terms of compromise shall form part of the Award. Consequently, the connected Miscellaneous Petitions are closed.
