Both the defendants have applied for condonation of the delay of 85 days in filing the written statement.

2. In the affidavit in support of the application, the first applicant has stated that he was unwell and therefore could not coordinate with counsel. Learned counsel for the plaintiff has no serious objection to this application being allowed.

3. Considering the reasons stated, the application is allowed as prayed for. Therefore, the Registry is directed to receive the written statement of the defendants.
