MAIN BRANCH OFFICE NEW ROAD, KATTHMANDU, NEPAL Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to order service by an on respondents 2,3,4, and 7 by an advertisement in a news paper circulating the Nepal in the interest of Justice, and pass such further order or orders in CMP.1336/17 in AS.NO.54/2006.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.SANKARAN, Advocate for the petitioner and of Mr.B.RAMAMOORTHY AND G.VIVEKANAND, Advocate for the 1st respondent and Mr.K.THANGAPANDI, Advocate for the 5 & 6 respondent the court made the following order:- This application has been filed to seeking substituted service on respondents 2,3,4 and 7 in the appeal.

2.A perusal of the records shows that the respondents 2,3,4 and 7 have remained ex-parte before the trial Court. Hence notice to them in the appeal is dispensed with in terms of order XLI Rule 14[1] C.P.C., this application is dismissed as unnecessary.

3.Registry is directed to print the names of Mr.B.Ramamoorthy, & G.Vivekanand, learned counsel for 1st respondent, and Mr.K.Thangapandi, learned counsel for 5th and 6th respondents and post the appeal for final hearing on 14.02.2017.
