Reliance General Insurance Company Ltd v. Chellammal

C.M.P.No.8391 of 2023 in C.M.A.SR.No.12249 of 2023 N.MALA, J., This Petition has been filed to condone the delay of 242 days in filing the appeal against the Judgment and decree dated 19.03.2022 passed in M.C.O.P.No.5605 of 2015 on the file of the Motor Accident Claims Tribunal(II Small Causes Court) Chennai.

2. The learned counsel for the petitioner submits that notice to the second respondent may be dispensed with as the second respondent remained ex-parte before the Court below and he has also made an endorsement to that effect.

3. In view of the submission made by the learned counsel for the petitioner, notice to the second respondent is dispensed with. 4.The learned counsel for the contesting first respondent has no serious objection to the delay of 242 days being condoned.

5. In view of the same, the delay of 242 days is condoned and accordingly the petition is ordered.

6. Both the learned counsels submit that the matter may be referred to Mega Lok Adalat to be conducted on 13.05.2023. https://www.mhc.tn.gov.in/judis 1/2

7. Considering the submissions made by the learned counsel for both sides, the matter is directed to be listed on 13.05.2023 before the Mega Lok Adalat.

8. Registry is directed to list this case before the Mega Lok Adalat to be held on 13.05.2023.
