JUDGMENT

(Judgment of the Court was pronounced by T.RAJA, J.) This Appeal Suit has been filed against the judgment and decree dated 11.10.2018 passed in O.S.No.28 of 2013 by the learned Additional District Judge, Namakkal in and by which a preliminary decree was passed for partition of the suit properties thereby allotting 1/6th share each over the Schedule I of the suit properties by metes and bounds to the plaintiffs and the 4th defendant therein/appellants herein with a specific finding that they have got no share over the Schedule No.II of the suit properties.

When the matter was called to-day, it was represented on either side that the dispute between the parties has been settled out of Court, therefore, the appeal may be dismissed as settled out of Court and a memo to that effect was also filed by the learned Counsel for the appellants.
