ORDER

This Writ Petition has been filed to direct the respondents to furnish certified copies of Post-Mortem Report No.1224/2024 and Toxicology Report No.3698/2024 to the petitioner.

2.Learned counsel for the petitioner submits that the petitioner is the mother of Hardra Mithun, a deceased. On the death of the said Hardra Mithun, a case in Crime No.382 of 2024 registered under Section 194 of B.N.S.S. by the 1st respondent. Learned counsel further submits that the petitioner made a request on 19.11.2025 seeking certified copy of the Post Mortem Report of Hardra Mithun, Chemical Analysis Report, Biological Report and other documents pertaining to the case and also the full name, designation of the Doctor who conducted postmortem. The petitioner initially sent a request to the Public Information Officer seeking the above said copies, thereafter, a further representation dated 01.12.2025 was submitted. Subsequently, an Advocate Notice dated 18.02.2026 was issued on behalf of Mrs.Ashwini, as Authorised Representative and Legal Advisor. Since there was no response to the said requests and notice, the petitioner filed the present petition seeking issuance of the above said copies. Page No.2 of 4

3.Learned Additional Public Prosecutor appearing for the 1st respondent Police strongly opposed the petitioner's prayer and submitted that the petitioner is an accused in Crime No.382 of 2024. Initially, FIR in Crime No.382 of 2024 registered under Section 194 B.N.S.S., on 05.08.2024 and now the petitioner is a named accused. As against the petitioner, investigation completed, charge sheet filed before the learned Judicial Magistrate No.II, Tambaram and P.R.C.No.32 of 2025 assigned. He further submits that the petitioner received the copy of the charge sheet which contains the documents now he sought for and also other documents. Now the case is posted for committal on 24.04.2026. 4.Considering the submissions and on perusal of the materials, it is seen that the petitioner is an accused in Crime No.

382 of 2024 and the petitioner cannot claim, as a matter of right, the Post-Mortem Report or Toxicology Report until the investigation is completed and charge sheet is filed. In this case, investigation completed, charge sheet filed and copy of the same also served to the petitioner before the committal Court/Judicial Magistrate No.II, Tambaram.

vv2 5.In view of the above, this Court is not inclined to entertain this petition. Accordingly, this Writ Petition Criminal stands dismissed. No costs.
