A.No.4544 of 2022 in O.P.No.655 of 2007 R.N.MANJULA,J.

This application has been filed by the applicant / petitioner to implead the proposed respondent No.5 as a party to the proceedings.

2. One of the sons of late V.Balarama Naicker has filed this Original Petition seeking Letters of Administration in respect of the alleged Will dated 01.03.1993 said to have been executed by the late V.Balarama Naicker.

3. The learned counsel for the applicant submitted that two sons of late V.Balarama Naicker and two children of another pre-deceased son by name B.Venkatesan has been impleaded as parties to the proceeding, the wife of the said B.Venkatesan is omitted to be impleaded as a party. Hence, this application has been filed.

4. The respondents did not file the counter. It is right on the part of the applicant to claim that the wife of late B.Venkatesan should be added as a party to the proceedings. In the interest of justice, this application is allowed.
