ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.08.2024 for the alleged offences punishable under Sections 8(c) r/w. 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.225 of 2024 on the file of the respondent police, seeks bail. 1/4

2.The petitioner earlier filed a bail petition before this Court in Crl.O.P.No.2255 of 2025 and the same was dismissed by this Court on 14.02.2025 on the ground that the contraband seized is a commercial quantity and recovery has been made from the petitioner. 3.The learned counsel for the petitioner submitted that now investigation completed, final report filed and there is a change in circumstances. He also stated that there is no sample taken. 4.Per contra, the learned Government Advocate (Crl. Side) submitted that all the mandatory provisions under NDPS Act were complied with and earlier bail petition was dismissed after filing of the final report on 24.01.2025. Hence, the change of circumstances relied on by the petitioner is not proper.

5.I have also gone through the records and it is found that the order dated 14.02.2025 was passed after filing of the final report and this Court had considered the case on merits and dismissed the bail petition. Since there is 2/4

no change in circumstances after the dismissal of the earlier bail petition filed by the petitioner, I am not inclined to entertain this bail petition and hence, the Criminal Original Petition is dismissed.
