ORDER

This Writ Petition has been filed seeking for a Writ of Mandamus, to direct the respondents to consider the petitioner's representation dated 02.11.2022 (to grant victim compensation for sum of Rs.1,00,000/- (One Lakh) along with interest.

2. It is the case of the petitioner that her son met with an accident and was declared as brought dead by the Doctor. The H-1, Wannarapettai Police Station registered a F.I.R. in Crime No.93 of 2017 for alleged offence u/s.304(A), 184 IPC based on a complaint given by one Sundhar a laundrer who witnessed the scene of occurrence. Further, the third respondent forwarded a Government Order dated 18.8.2017 to the second respondent to award compensation to the victim from the Chief Minister Relief Fund. Since the second respondent did not comply with the said G.O., the petitioner made a representation dated 2.11.2022 to the respondents seeking to grant compensation to the victim along with the interest, which also remained unanswered. Hence the present writ petition.

Though very many grounds have been raised in the present writ petition, learned counsel for the petitioner submits that it would suffice if this Court issues a direction to the respondents to consider the petitioner's representation dated 02.11.2022 and pass appropriate orders within the time frame that may be fixed by this Court.

4. On the above contentions heard learned Additional Government Pleader appearing for the respondents and perused the materials placed before this Court.

Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the respondents to consider the petitioner's representation dated 02.11.2022 and pass appropriate orders on merits and in accordance with law after affording an opportunity of hearing to the petitioner as well as the aggrieved persons if any within a period of four weeks from the date of receipt of a copy of this order. 3/5
