Mr.E.Balamurugan, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a mandamus directing the respondents to rectify the mistake crept in classification and to grant Patta in Survey No.21/3, situated at Kappalampadi Village, Melmalayanur Taluk, Villupuram District, based on her representation dated 30.11.2018.
3. It is stated that the petitioner's family is in possession and enjoyment of the above said property. It is further stated that the said property was originally classified as "Grove (Thoppu)" in the Revenue records. Thereafter, the said property was wrongly classified as "Channel" in the Revenue records. Hence, the petitioner made a representation on 30.11.2018 to the respondents seeking to rectify the mistake crept in the classification and to grant patta in her favour in respect of the above said property. The grievance of the petitioner is that the said representation has not been considered by the respondents so far. Hence, the present writ petition.
4. Heard both sides.
5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the respondents 2 & 4 to consider and pass appropriate orders on the same on merits and in accordance with law. Thus, this writ petition is disposed of, only with a direction to the respondents 2 & 4 to consider the representation of the petitioner 30.11.2018 and pass appropriate orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the respondents 2 & 4 within a period of twelve weeks from the date of receipt of a copy of this order.
